These Terms explain your rights and responsibilities when using MailJuke services.

MailJuke is operated by Nish Global Solution.

1. Agreement and Eligibility

  • Services are intended for lawful business use by users age 18+.
  • If you use MailJuke for a company or client, you confirm you are authorized to bind that organization.
  • These Terms form a binding agreement between you and MailJuke when you create an account, use the platform, or purchase services.

2. Service Scope

  • MailJuke provides domain and email workflows, DNS setup tools, workspace administration, billing utilities, and related platform functionality.
  • We may add, change, pause, or remove features at any time.
  • Unless agreed in writing, custom development or custom integration work is not included.

3. Third-Party Providers

  • MailJuke relies on third-party systems (such as registrars, DNS providers, email providers, and payment processors).
  • Your use of connected providers remains subject to their own terms and policies.
  • MailJuke is not liable for third-party outages, suspensions, API changes, enforcement actions, or provider-side failures.

4. Accounts, Workspaces, and Access

  • You are responsible for account security and all activity under your credentials and authorized users.
  • Workspace admins can manage data, settings, users, and purchases based on permission scope.
  • You are responsible for setting appropriate user access levels.

5. Orders, Billing, and Taxes

  • Recurring services renew automatically unless canceled before renewal.
  • By placing orders or storing payment methods, you authorize charges for subscriptions, renewals, add-ons, usage, and applicable taxes.
  • Paid services may include recurring and one-time charges.
  • Prices and packaging may change prospectively.

6. Refunds and Chargebacks

  • Limited exceptions may apply, such as verified duplicate billing errors or failure to provision a paid service due to MailJuke fault.
  • Fees are generally non-refundable unless required by law or approved by MailJuke.
  • Improper chargebacks may lead to suspension, cancellation, and collections.
  • MailJuke may issue wallet/service credit instead of a cash refund.

7. Domains and DNS

  • You are responsible for rights and authority over domains you register or connect.
  • DNS and nameserver changes can be delayed, rejected, or partially applied by external systems.
  • You remain responsible for renewals, expiration windows, and domain status, even if reminders are provided.

8. Email and Delivery Outcomes

  • MailJuke does not guarantee inbox placement, open rates, replies, or campaign performance outcomes.
  • You are responsible for sender behavior, recipients, content, compliance, and campaign practices.
  • Email provisioning timelines are estimates and not guaranteed.

9. Acceptable Use

  • You may not use MailJuke for fraud, phishing, illegal spam, malware, impersonation, or unlawful activity.
  • You must follow applicable laws and third-party platform rules.
  • MailJuke may investigate misuse and suspend/terminate access when necessary.

10. Privacy and Data Handling

  • Personal data handling is governed by the MailJuke Privacy Policy.
  • You are responsible for ensuring lawful collection and use of customer data submitted to the platform.
  • MailJuke may use aggregated or de-identified data for lawful product and business purposes.

11. Intellectual Property

  • MailJuke and its licensors retain ownership of the platform, code, designs, and documentation.
  • You receive a limited, revocable license to use the services for internal business operations.
  • Feedback you provide may be used by MailJuke without compensation.

12. Suspension and Termination

  • You may cancel at any time; cancellation applies to future renewal periods.
  • MailJuke may suspend or terminate access for breach, non-payment, fraud, risk, chargebacks, or legal reasons.
  • On termination, access may end immediately and some data/assets may be deleted per policy and provider constraints.

13. Disclaimers and Liability Limits

  • MailJuke disclaims implied warranties, including merchantability, fitness, and non-infringement.
  • Services are provided on an 'as is' and 'as available' basis to the fullest extent allowed by law.
  • To the maximum extent allowed by law, MailJuke is not liable for indirect or consequential damages.

14. Governing Law and Disputes

  • These Terms are governed by Delaware law.
  • Disputes are subject to exclusive jurisdiction in Delaware state or federal courts.
  • Class-action and jury-trial waivers apply to the extent permitted by law.

15. Updates and Contact

  • MailJuke may update these Terms from time to time. Continued use after updates means acceptance of revised terms.
